UN Resolutions are NON-BINDING – Sri Lanka’s Government helping create Precedents that would be detrimental to sovereignty of all UN Members
Member nations of the UN are advised to keep a close watch on the current developments in Sri Lanka. They must take note of the manner Sri Lanka is being used as a guinea pig by Western imperial powers using UN & UNSG as their puppets to tweak national laws and undermine the nation’s security, sovereignty and territorial integrity. This experiment is clearly to bring Sri Lanka under the rule of UN laws and the success of the experiment using local sepoys and lascoreens will have equal and adverse impact upon other UN member states who will be subject to these same nuances now being rolled out and accepted with open arms by local puppets in government. These are all aligned to the plan to remove the nation-state system whereby nations will no longer have sovereignty over their people or the resources in their countries. The pathetic situation Sri Lanka is today experiencing and the precedents being created must worry other UN member states for they are likely to be the next targets.
First let us look at the non-binding nature of UN resolutions.
The powers and functions of the United Nations General Assembly (UNGA) are clearly set out in Article 10 through 17. GA resolutions are merely recommendations, not laws, and thus not binding on member states. In short there is no legal obligation by governments to implement or even consider UN resolutions. If such is the status quo for the UN General Assembly resolutions why has Sri Lanka’s advisors not made this clear to the Sri Lankan governments who have accepted UNHRC Resolutions drafted by nations that commit crimes with impunity without even diplomatically wording the status quo! (refer : Hurd, Ian (2011), International Organizations: Politics, Law, Practice)
Under the principle of pacta sunt servanda (‘agreements must be kept’), treaties are binding on the parties and must be performed by them in good faith. But this does not mean that every provision of a treaty creates a legal obligation, the breach of which entails non-compliance.
Resolution 1653 states the use of nuclear weapons would constitute a direct violation of the UN Charter. However, the US used Agent Orange in Vietnam, US used white phosphorus in Iraq and the US has been flouting every customary law passed by the UN. In fact Julian Assange in 2007 claimed that US has at least 2386 ‘non-lethal’ chemical weapons deployed in Iraq. US is alleged to have used sarin nerve gas in Laos.
If all members of the UN are equal how is it that US and NATO nations can flout all laws and universally accepted norms while these violators can use the podium of the UN to point fingers at other nations and draft resolutions for UN to take action against them? We are puzzled. There cannot be different laws for some and no laws for others while some can flout all laws and nothing happens to them while propaganda and false reports can accuse other countries and these countries alone are subject to the UN gavel!
The lies that facilitate UN intervention
Genocide propaganda lies
- 40,000 figure was used in Srebrenica and same figure is being used against Sri Lanka. How convenient!
- Media went to town, foreign nations went to town, lies and propaganda sufficed to break up Yugoslavia and create Kosovo which was really to set up a NATO base that could target Russia. So you have to wonder what the aim of the 40,000 dead in Sri Lanka is all about when none of those claiming the figure can produce names or details of the dead but want to set up an office where fabrications can continue until the objective is achieved.
- Funnily enough the hype ended up a virtual “puswedilla” with less than 2000 dead! We know the same fate will await Sri Lanka’s bogus ‘genocide’ claim where Tamil population is increasing amidst genocide!
Farcical ‘war criminal’ propaganda
- The President of Serbia, Slobadan Milosevic was called the Butcher of Serbia, he was ridiculed arrested where he died suspiciously in prison and then 14 years later the ICC now says Milosevic is not a war criminal. Not even an apology or compensation for his family or the nation the UN/US & West broke up.
Incubator lie that resulted in invasion of Iraq in 1991
- Forgotten is the lies that went into coercing Saddam Hussein to invade Kuwait and thereafter using the media to create incubator death of children story to justify the invasion by US of Iraq in 1991 (Gulf War 1) which resulted in scores of deaths, the Iraqi sanctions and the UN complicity in Oil-for-Food program.
WMD lies that justified Iraqi invasion in 2003
9/11 used to attack Afghanistan
- None of the hijackers were Afghans but US & NATO attacked and continue to occupy Afghanistan with no end to reducing military presence.
Lies continue to justify strikes against Syria that has virtually devastated the country and made refugees of its people, with the migrant crisis spilling across Europe as part of a bigger game to destabalize European nations the same is taking place in South America as well.
We now come to Sri Lanka. Everyone knows Sri Lanka has been ravaged with a terrorist problem otherwise why else would 32 nations ban LTTE as a terrorist organization. However, throughout 30 years of killings the UN and Rest of the World had only one advice ‘talk to the terrorists’ and talk we did but it did not stop the terror or killings inspite of ceasefires, negotiations even change of climate taking terrorists to foreign climes and even hosting them in 5 star hotels!
None bothered to investigate the links to terrorist organizations and tabulate the parties/individuals/
What needs to be said is that the UN did not stop terror in Sri Lanka, did not stop child recruitment to LTTE, did not stop Tamil low caste civilians from being forcibly inducted to the LTTE, did not stop unpaid labor by LTTE, did not stop LTTE’s violation of UN fundamental rights and when the Sri Lankan Army did eliminate the LTTE ground force while also saving close to 300,000 Tamils (some of whom were LTTE in civilian clothing) the UN cries foul, demands accountability, demands tribunals and now wishes to set up missing offices wherein the war criminals are the Sri Lankan soldiers and the victims are the LTTE.
This is a repeat of what the UN did in Yugoslavia and how UN helped the creation of Kosovo (incidentally the architect is now investigating Sri Lanka for UNHRC) and South Sudan where the UN are abandoning the people having done its mission on behalf of the West foreignpolicy.com
What is currently noteworthy in the UN/UNHRC hysterical role in Sri Lanka’s accountability is the manner that the UN is getting the local stooges to virtually hand over governance on a platter to the UN.
Leaving aside the illegality of the resolutions based on a personally commissioned report for the UNSG and the conflict of interest by the former UNHRC head who after leaving office attends LTTE front events overseas a lot of lies has gone into castigating Sri Lanka in order to justify a war crimes tribunal.
The new OMP bill will be not subject to right to information or can be questioned by local court in any of its deliberations. The office can compile any amount of lies and not have the witnesses cross –examined. What kind of legal and justice system is this!
But wait and watch the UNSG will have a prepared speech showering praises about the OMP and anyone going through the contents will be shocked at how the UN has managed to sweep powers upon itself and this case is detrimental to other member nations of the UN who can be subject to the same scenario simply by tapping into groups of weak locals ready to sell their soul. People’s integrity have waned… throw some money, use a woman/man/or others and sexual promiscuity has brought down even Presidents! Promises perks and privileges and these locals would just about do anything. Such is the state of affairs that has befallen Sri Lanka.
Those following the UN and its bodies and connecting the programs they are presently rolling out (Agenda 2030, Global Goals etc) will notice how far the UN is contriving to remove the powers national governments control and transfer them to UN which invariably means a handful of private corporates and lobbies will be controlling the world, the people and all resources in time to come.
While we have seen little opposition by India to these developments, we would like to see Russia and China coming forward to counter these by ensuring that the UN does not remove the sovereign national powers vested in nations failing which Russia and China must call for all nations to exit the UN and formulate a better global forum which does not have one law for some and no law for others.
