GSLF to Complaint Against UNHRC – Senaka Rajapaksha

The Hon. President of Global Sri Lankan Forum (GSLF) Poland stated that Resolution 30/1 of October 2015 called upon Sri Lanka to implement legal reforms including constitutional reforms. Those are matters usually fall within the domestic jurisdiction of a sovereign State and Council should not have interfered, because of Article 2(7) of the U.N. Charter. Nevertheless UPA 2017 endorsed that Sri Lanka has tremendously improved its ability to protect and promote Human Rights. So, the President of GSLF–Poland Senaka Rajapaksha argued that the Complaint Procedure Mechanism under Chapter 4 of resolution 5/1 is one accepted method that allows an aggrieved party like citizens of Sri Lanka to complain against primary decisions of the Council.

Rajapaksha explained this mechanism to the world leaders at the 39th session of UNHRC held in Geneva.

Mr. President,

The Complaint Procedure Mechanism under Chapter 4 of resolution 5/1 is one accepted method that allows an aggrieved party to complain against primary decisions of the council.

Last March, two of my colleagues filed an unprecedented petition under the Complaint Procedures mechanism, complaining of a possible violation of human rights by the UNHRC itself.

Resolution 30/1 of October 2015 called upon Sri Lanka to implement legal reforms including constitutional reforms. Those are matters usually fall within the domestic jurisdiction of a sovereign State and Council should not have interfered, because of Article 2(7) of the U.N. Charter. Nevertheless UPA 2017 endorsed that Sri Lanka has tremendously improved its ability to protect and promote Human Rights.

Unfortunately, citizens of Sri Lanka aggrieved by resolution 30/1 cannot take advantage of this situation to challenge the resolution in the Council, because the Government of Sri Lanka has co-sponsored the resolution.

The Complaint Procedures mechanism is the only way to officially bring this injustice to the Council’s attention. We the patriotic citizens urge that the Council impose a moratorium on all actions in respect of Sri Lanka pending the outcome of our complaint.
