Open Letter to President’s Actions on Protecting of Forest in Ampara and Wilpattu
Following numbers of requests made on the deforestation in Eastern province by two politicians in the ruling party, the HE the President Maithreepala Sirisena has taken some actions to stop such deforestations.

I am writing to thank you for the prompt action taken by you to halt the on going unauthorized encroachment into the conservation properties of the Wilpattu National Sanctuary as announced on the News First TV program of Saturday, May 9, 2015, the link to which is given below.
I trust a full inquiry will be made on an urgent basis, and arrangements made to resettle the displaced people outside the environmentally sensitive National Park in their original places of habitation doing justice to both the affected people and the ecological treasures of the nation.
I do hope that you will also look into similar encroachments in the Ampara-Bakmitiyawa-Thimbirigolla area, and illegal encroachment of coastal and forest reserves in the Pottuvil and Lahugala Divisional Secretariat areas with the collaboration of politicians and government officials. I am confident that the positive measures you have embarked on will help to eliminate the degradation of the nation’s most treasured forested environment and prevent impending chaos and unlawful conduct. Existing laws need to be firmly enforced without fear or favour notwithstanding the special interests of opportunistic politicians who only look at short term goals and lack an understanding of the nation’s long term
well being.
I would also like to take this opportunity to commend the JVP for taking a delegation to make a site inspection of the encroachments taking place in the Wilpattu National Park, and contributing their efforts in resolving these illicit actions to grab land in an area clearly demarcated as a protected sanctuary. Further to my letter dated April 27, 2015 regarding the ‘Rape of Wilpattu’, I have now come across yet another occurence of unauthorized clearing of protected forest cover and grazing lands in the Ampara-Bakmitiyawa-Thimbirigolla area where around 1,000 acres have already been forcibly cleared.
These actions have also apparently been undertaken with the knowledge and approval of politicians, namely, Mr. A.L.M. Athaulla and Mr. Rauf Hakeem who are named in the annexed report.
I do not have to emphasize the need to enforce the existing laws and prevent such violations no matter whosoever is involved and encouraging others to break the laws of the land with impunity.
If no action is taken immediately, you will be giving rise to a chaotic situation where people would blatantly cause damage and degradation to the environment and highly sensitive ecology without care or concern. The authorities cannot be looking aside merely because prominent politicians are involved with these violations. PLEASE ACT WITHOUT DELAY.

වන සංරක්ෂණ ආඥ පනතට අනුව 2010 ඔක්තෝබර් 01වන දින අංක 1673/45 දරන ගැසට් නිවේදනයට අනුව හෙක්ටයාර 47136ක් වන බක්මිටියාව – තිඹිරිගොල්ල වන රක්ෂිතය ප්රකාශයට පත් කර තිබේ. මෙම වන රක්ෂිතය, ලාහුගල – කිතුලාන ජාතික වනෝද්යානයට මායිම් වන අතර ඉතා විශාල අලි ගණනකට රැකවරණය සලසන ප්රදේශයකි. මෙම වනාන්තරය හා තෘණ බිම් එළිපෙහෙළි කර වගා බිම් ව්යාප්ත කිරීම හේතුවෙන් වාසස්ථාන අහිමි වන අලි – ඇතුන් එ් ආශ්රිත ව පිහිටි සාගම, අලයාඩිවිම්බු හා අලිගම්බේ යන ගම්මානවලට පිවිසීමේ වැඩි අවධානමක් පවතී. මේ නිසා මේ ප්රදේශයේ අලි – මිනිස් ගැටුමක් අලූතින් නිර්මාණය විය හැකි වන අතර එ් හේතුවෙන් අලි – ඇතුන්ට හා ගම්වාසීන්ට ජීවිතවලින් පවා වන්දි ගෙවීමට සිදු වේ. මෙවන් හානි කර තත්ත්වයන් ඇති කිරීමට පටු දේශපාලන පරමාර්ථ වෙනුවෙන් රජයේ වගකිව යුතු අමාත්යාංශ භාරව කටයුතු කරන ඇමතිවරුන්ගේ සහයෝගය ලබා දීම පිළිබඳව අප කණගාටු වෙමු.
නීති විරෝධී ලෙස එළිපෙහෙළි කරන සමහර ප්රදේශ කිරි ගොවිතැන වෙනුවෙන් වෙන් කළ තෘණ භූමි වේ. මහජන ආරක්ෂක ආඥ පනත යටතේ 1976.09.17 වන දින අංක 231 දරන ගැසට් නිවේදනයෙන් අක්කර 4000ක භූමි ප්රදේශයක් වට්ටමඩු තෘණ බිම ලෙස අලයාඩිවිම්බු කිරිගොවීන් සඳහා අම්පාර දිස්ති්රක් ලේකම් විසින් වෙන් කර තිබේ. එම ප්රදේශය අද වන විට බක්මිටියාව – තිඹිරිගොල්ල වන රක්ෂිතයට ඇතුළත් කර තිබේ. මෙම තෘණ භූමිය කිරි ගොවි පවුල් 168කට අයත් කිරි ගවයන් 15,000ක පමණ ප්රධාන පෝෂක තෘණ භූමියකි. මෙම ප්රදේශය බලහත්කාරයෙන් අත්පත් කරගෙන වගා බිම් ව්යාප්ත කිරීම හේතුවෙන් කිරි ගොවි කර්මාන්තයේ නිරත ජනතාව දැඩි අසීරුතාවයකට පත් ව සිටී.
පන්නල් ඔයේ හා සාගම වැවේ ප්රධාන ජලපෝෂක ප්රදේශයක් වන මෙම වනාන්තරය හා තෘණ භූමි එළිපෙහෙළි කිරීම හේතුවෙන් සාගම වැව යටතේ වගා කටයුතු සිදු කරන සාගම වෙල් යායේ යල මහ දෙකන්නයේ වගා කටයුතු සිදු කිරීමට ජලය හිඟ වීමෙන් ගොවි ජනතාවට ගැටළු රැසකට මුහුණ දීමට ඉදිරයේ දී සිදු වනු ඇත.
2009 අංක 65 දරන පනතින් අවසන් වරට සංශෝධිත 1907 අංක 16 දරන වන සංරක්ෂණ ආඥා පනතේ 7 වන වගන්තියට අනුව වන රක්ෂිතයකට අනවසරයෙන් ඇතුළු වීම, රැදී සිටීම, ශාක කපා ඉවත් කිරීම, වගා බිම් සැකසීම, වගා කටයුතු සිදු කිරීම, වනාන්තර ඉවත් කිරීමට හා වගාබිම් සැකසීම සඳහා යන්ත්ර සූත්ර භාවිතා කිරීම යන සියල්ල නීති විරෝධී වේ. මේ ක්රියාවල නිරත වන පුද්ගලයන් වරද කරුවකු වන අතර වසර 5ක් දක්වා බන්ධනාගාර ගත කිරීමකට හෝ රුපියල් 10,000ත් ලක්ෂයත් අතර දඩ මුදලකට හෝ මේ දඩුවම් දෙකටම හෝ යටත් කළ හැකි ය. මීට අමතර ව රක්ෂිත වනයට සිදු කරන ලද හානිය සඳහා ද අධිකරණය නියම කරන දඩයකට යටත් කළ හැකි ය. මීට අමතර ව මේ නීති විරෝධී කි්රයාවන් සඳහා ආධාර හා අනුබල ලබා දෙන පුද්ගලයන් ද වැරදි කරුවන් වන අතර ඔවුන්ව ද මේ දණ්ඩනයන්ට යටත් කළ හැකි ය.
එ්.එල්.එම්. අතවුල්ලා හා රවුෆ් හකිම් යන අමාත්යවරුන්ගේ සහයෝගය හා මඟපෙන්වීම මත මේ නීති විරෝධී ක්රියා සිදු කළ ද ඊට එරෙහිව මෙම නීති ක්රියාත්මක කිරීමට වන සංරක්ෂණ දෙපාර්තමේන්තුව අපොහොසත් වී තිබේ. එ් හේතුවෙන් බොහෝ ජනතාව පීඩනයට පත් වීම හා වන රක්ෂිතයේ පැවැත්ම ද දැඩි බලපෑමකට ලක් ව තිබේ.
කිරි ගොවීන් වෙනුවෙන් වෙන් කළ තෘණ භූමි විනාශ කරමින් මහජන ආරක්ෂණ ආඥ පනත උල්ලංඝනය කරමින් සිදු කරන මේ විනාශයට එරෙහිව කටයුතු කිරීමට 1976 ජුනි 17 වන දින අංක 217/51 දරන ගැසට් නිවේදනයට අනුව අම්පාර දිස්ත්රික් ලේකම්වරයාට බලතල ඇත. නමුත් එ් සඳහා මේ වනතුරුත් කිසිදු ක්රියාමාර්ගයක් ගෙන ඇති බවක් පෙනෙන්නට නොමැත.
ශ්රී ලංකා ප්රජාතාන්ත්රික සමාජවාදී ජනරජයේ ආණ්ඩුක්රම ව්යවස්ථාවේ 14 වන වගන්තියට අනුව නීත්යානුකූලව රැකියාවක හෝ වෘත්තියක නිරත වීමේ අයිතිය සෑම පුරවැසියකුටම හිමිය. එම අයිතියට බලපෑම් කරමින් කිරි ගොවීන්ගේ තෘණ භූමි මෙලෙස විනාශ කිරීම මූලික අයිතිවාසිකම් කඩ කිරීමකි. එ් සඳහා අධිකරණ අමාත්යවරයා ම ආධාර හා අනුබල ලබා දීමෙන් පෙනී යන්නේ ජනතාවගේ මූලික අයිතිවාසිකම් පිළිබඳව කිසිදු තැකීමක් වත්මන් රජය විසින් සිදු නොකරන බව ය.
වන රක්ෂිතය විනාශ කරමින් සිදු කරන මෙම දැවැන්ත වනාන්තර එළිපෙහෙළි කිරීම හා නීති විරෝධී වගා බිම් ව්යාප්ත කිරීම හේතුවෙන් සාගම, අලයාඩිවිම්බු හා අලිගම්බේ ගම්මානවල ජනතාව අලි – මිනිස් ගැටුමේ ගොදුරක් බවට පත් වීම, අලයාඩිවිම්බු කිරි ගොවීන් අවතැන් වීම හා සාගම ගොවි ජනතාව අවතැන් වීම සිදු වුව ද එ.එල්.එම්. අතාවුල්ලා හා රවුෆ් හකීම් අමාත්යවරුන්ගේ හිතවතුන් කිහිපදෙනෙකු වෙනුවෙන් මේ ගම්මානවල ජනතාව අවතැන් කිරීම සිදු කරති. ඔවුන්ගේ යැපුම් මාර්ග අවදානමට ලක් කිරීම සිදු කරති. මෙවන් දේශපාලකයන් මහජන නියෝජිතයන් ලෙස හැඳින්විය හැකි ද යන්න ගැටලූවකි.

Continued Rape of the Wilpattu National Park and
Establishment of Unauthorised Settlements
I am writing to bring to your notice the continuing rape of the Wilpattu National Park that is taking place at this very moment, whilst the authorities responsible for the conservation of forests and protection of the environment are hibernating in their comfortable offices in the
capital city. When this matter was brought up earlier by another group of concerned citizens with photo evidence, they pointed a finger at a minister of the state whom I believe was Mr. Rishad Badthiutheen, as being the person responsible for the encroachment and construction of houses for settling members of his community. I note that Mr. Badthiutheen is once again holding a cabinet rank in your administration as well.
I am giving below a link to a 5 minute 51 second video which shows the construction of roads and permanent houses within the Wilpattu National Park. This is a clear violation of the existing laws relating to conservation of the limited forest cover in the island needed for climatic reasons as well as provision of areas for our wild life to freely roam in safety as envisioned by our wise rulers from ancient times. You will observe paved roads and permanent houses already in place, with road extension and house construction underway. A board has been erected denoting this illegal housing project on encroached crown land in a conservation area as ‘JASSIM CITY’ comprising a total of 179 houses.
The funding has been provided according to the signboard by Sheikh Jassim Bin Jabor Al-Thani Charitable Foundation based in Doha, Qatar. Does the law allow foreign organizations to establish cities for members of a particular community on Sri Lanka’s sovereign territory involving the deforestation of national parks which are deemed conservation zones? Such funds should instead be directed to the government to resettle Muslims and others who were internally displaced in their former places of residence.
The usual reason given for such illegal action is that there has been a delay on the part of the
government to re-settle members of the Muslim community who had been forcibly evicted by the LTTE from their abode in the northern province. There were also over 27,000 Sinhala people who had also been evicted from the north by the separatist Tamil terror groups between 1971 and 1981, none of whom have been resettled by the state, except for a handful of about 25 families who have staked out their temporary homesteads in Navattakuly without any assistance from the state.
The right of return of those who had been forcibly evicted by the Tamil terror groups who carried out ethnic cleansing of non-Tamils in both the north and east must be honoured by the government.
While there are an abundance of laws established in Sri Lanka, the failure to prevent wrongdoing is mainly due to the non-enforcement of the laws by the authorities concerned. Could this be as a result of political interference which prevents officials from carrying out their entrusted duties?
I have also been made aware of similar encroachments in the Eastern Province by members of the Muslim community into strictly conservation areas such as the forests surrounding the estuaries of waterways flowing to the sea, and even producing bogus deeds prepared by members of their own community working in the kachcheri or district office administering the area. We are also aware of the ‘Ashraf Nagar’ where 500 houses were built on land close to the Deegavapi Temple complex in the Ampara district supposedly to house 89 Moslem families who had been displaced by the 2004 tsunami, nearly 30 miles inland from their original place of residence with funding from the Middle East.
I trust that you would initiate an investigation immediately and take appropriate action against who so ever has had a hand in this unlawful venture to build unauthorized houses by encroaching into conservation properties belonging to the state. These houses have to give way to the preservation of the National Park, and steps taken to restore the forest cover without delay. Notwithstanding ethnicity, the government must uphold the law in order to win the trust and confidence of the people.
