Wives of Soldiers filed plaint

The wives of two army officers who are in detention in connection with the abduction/killing of journalist Prageeth Ekneligoda have filed two Habeas Corpus petitions in the Court of Appeal.

R. Wasantha Padmaseeli and E. Nirmala Sudashin filed plaint on behalf of their husbands Sergeant Major W.G.U.P.D. Upasena and Lance Corporal Ravindra Rupasinghe.

They have said in their petitions that their husbands had been arrested in connection with the abduction of Prageeth Ekneligoda.
Petitioners have stated that their husbands had nothing to do with Ekneligoda’s abduction, but they were unlawfully arrested and detained on an error in law and have hence had their fundamental rights infringed.
The petitioners further state that their husbands have been arrested unlawfully under the PTA, since the incident pertaining to the Prageeth Eknegligoda’s disappearance does not fall under the list of offences under the PTA.
Therefore, petitioners request Court to direct the respondents to produce their husbands in Court and inquire into the alleged wrongful and illegal arrest and detention.

Nishantha Adrian Silva, Inspector of Police OIC Gang Robbery Investigation Unit of CID, Shani Abeysekera, ASP Sudath Nagahamulla, Director CID, N.K. Illangakoon IGP and four others have been cited as respondents.
